In consideration of you agreeing to abide by the terms of this EULA, we grant you a non-transferable, non-exclusive licence to use the App on the Devices, subject to these terms, the Privacy Policy and the App/Google Play Store Rules (including the Usage Rules), both of which are incorporated into this EULA by reference. We reserve all other rights.
You may download a copy of the App to, and view, use and display the App on, any device that you own or control for your personal purposes only, and as permitted by the Usage Rules.
You will be provided with a code to enter into the App once downloaded by your eye care professional, or by OKKO Health. Entry of the code will enable you to create your personal account.
The e-mail address that you use to access the App must be a personal individual email address that is not shared with any other people. Usernames and passwords will be specific to the individual users to which they are issued and will be single-use logins which must only be used by those specific individuals to whom they are issued. You must keep your username and password secure and confidential at all times. You must notify the OKKO Health team at [email protected] immediately if you become aware of any compromise in the security and confidentiality of your username and/or password, whereupon your username and/or password may be deactivated if reasonably necessary to do so.
OKKO Health shall not be responsible for any failure by you to access the App or any other loss or damage suffered by you which results from delays or failures in telecommunications networks and facilities (including the internet). No guarantees are given in relation to the availability times of the App.
OKKO Health will use their respective reasonable efforts to make the App available to you at all times on Business Days during the Licence Period (save for periods of required maintenance). However, OKKO Health does not make any representations or warranties that your use of the App shall be uninterrupted or error-free, or that defects in the App will be corrected or that the App will meet all your requirements. You acknowledge that there may be periods during which the App will not be available and that OKKO Health are under no obligation to notify you in advance if they become aware that the App may not be available for any reason. OKKO Health will use their respective reasonable endeavours to correct any defects in the App as soon as possible and to minimise any period of unavailability of the App but will not (to the extent permitted by Applicable Law) be liable to you beyond this commitment.
